Our view: Conflicted councilor can own up — or step down
The city attorney hasn’t ruled yet, but evidence is stacking up against Sharla Gardner, who soon could be referred to as a former Duluth city councilor.
The city attorney hasn’t ruled yet, but evidence is stacking up against Sharla Gardner, who soon could be referred to as a former Duluth city councilor.
She voted last year to give the nonprofit Duluth Sister Cities organization $60,000 in tourism tax funding. Last month, she voted to allocate $34,000 more in tourism tax dollars to the group. Meanwhile, she traveled to Japan with Sister Cities—a trip largely paid for by the organization, as the News Tribune’s Brandon Stahl reports in today’s edition.
In other words, she voted to fund an organization that paid for a big part of a trip she took overseas. And therein lies a conflict of interest.
Accepting the financial assistance also conflicts with the City Charter. The charter prohibits city officers such as Gardner from receiving “any pay, commission, money or thing of value, or derive any benefit, profit or advantage, directly or indirectly, from, or by reason of, any improvement, alteration or repair required by authority of the city.”
While an official finding of a conflict of the City Charter is a misdemeanor, it still would disqualify Gardner from the City Council. And that means that the conflict-of-interest ruling by City Attorney Gunnar Johnson, expected later this week, will be a big one.
Interviewed by Stahl yesterday, Gardner argued that she was working on the trip to Japan and “conducting city business.” As grateful as constituents can be for her service and her willingness to represent the city, they also expect that she and others elected to positions of public trust will conduct their duties with care, within the rules and laws and in a way that’s beyond reproach.
And constituents should be able to expect that no matter how much money is involved. On May 11, when the conflict question was first raised at a council meeting, Gardner dismissed the financial assistance, saying Sister Cities paid only “a few hundred dollars” of her airfare. But according to a receipt obtained by the News Tribune through a data practice request, the entire $1,443 of her airline ticket was paid for by the nonprofit.
Gardner’s apparent misunderstandings could stem from the reality that, until two years ago, Sister Cities was a city of Duluth entity. Elected officials were well within the rules and laws to take Sister Cities trips paid for by the program. Gardner was the first elected official on a trip since the group became a nonprofit.
She has an opportunity now to own up to the conflict, and she can do so before the city attorney offers his ruling. She could plead ignorance and apologize, acknowledging that no elected official is above the City Charter.
Or she could continue to deny wrongdoing, whether intentional or unknowing. And she could be forced to relinquish her seat on the City Council. |

" I have good news, We've discoverd the cause of the leak. The bad news is You have 72 hours to fix it.I was newly married, broke and making chicken feed for a paycheck.The repairs were made I took out a loan and the city was nowhere to be found for assistance. This Mayor has absolutely no creative bones in his body. He continually reaches into our pockets for his cure to all problems. Shame on you and your newly created administration Donny. If the Mayor and his band of merry spenders had gone to the state with the sewer overfill issue instead of begging for a new Hockey arena for the UMD Bulldogs we would not be having this conversation.This Mayor will most be remembered for this Phrase " WE MUST ALL SHARE THE PAIN." I agree with you about a choking child. 9 years ago my daughter chocked on a life saver. We called 911 and they were at our house within 5 minutes. In that time she swallowed it down the pipe and it could have been considered a 'false alarm'.
Yet they took the time to listen to her airwaves and made sure that it was actually in her stomach and still not in her throat. Its the only time I ever had to use them and I sure appreciated them being there when I needed them. |

| Having been involved in local government and knowledgable about city services, I have an answer to an earlier bloggers question as to, " how many false fire alarms does the Duluth Fire Department respond to?" The answer is almost 100%. The taxpayers of Duluth will never have an efficient use of it's fire department until it changes leadership on the council. The fire union has buffalo'ed the citizens for many years. Fact: Building codes, sprinkler systems,education, smoke alarms have saved more people from fire deaths than any Full-time fire department in the US in the last 26 years. We used to say that the fire dept. was on a "full-time publicity tour 24/7". Good Luck Duluthians! |

•Retirement programs. Congress has not set aside money to pay military and civil servant pensions or health care for retirees. These unfunded obligations have increased an average of $300 billion a year since 2003 and now stand at $5.3 trillion.

| I think after reading the paper this past week it was a very good idea for the police to charge on false police alarms. It is wasteful for our police officers to go to these alarms time after time just to find out they are false. At the council meeting I heard over 99% of police alarms are false. I hope any money brought in by this new ordinance will help buy items for the police officers. I also heard the fire departmint is going to be getting an ordinance of their own to deal with false fire alarms. I hope they can get their ordinance passed for false fire alarms so they can buy new equipment to. I like and respect our policemen and firemen. |

Duluth assessment disputes at record level
Claims disputing property assessments have averaged about two dozen per year. This year there have been 68.

How much would you pay for the Fitger’s on the Lake building, the Sheraton Hotel, the Milk House in Piedmont Heights, a small brick church on Superior Street, or even the New San Marco Apartments(WET HOUSE)?
The owners of those buildings are just a few of the record numbers who have filed suit against the city, claiming the assessed value of their properties — the sale prices they could fetch on the open market — have been set way too high.
“"Property owners are looking at their current financials and wondering, why aren’t their values falling?” City Assessor John Gellatly said. “And as sales go down, what continues to go up? Their taxes. And they’re looking for a way to cut one of their costs.”
In typical years, about two dozen property owners file claims, Gellatly said. But this is no typical year.
The recession is mostly to blame for the 68 claims against the city, people involved with the issue say. Those claims represent hundreds of properties, most of them commercial.
Property owners pay taxes this year based on assessments set in early 2008, which were determined by market conditions in 2007. But the market has dropped, along with property owners’ revenues and incomes. Gellatly said assessors’ offices across the state are reporting the same problems.
As a whole, the commercial market in Duluth is properly assessed, Gellatly said, adding that the median commercial sale price is about five percentage points below the assessment value, well within state standards.
Bill Burns, a tax attorney representing numerous property owners, agrees that overall commercial properties are properly assessed in the city. He also said he doesn’t blame Gellatly and the assessor’s office for some of the assessments he believes are way out of whack.
“It’s no secret that they’re understaffed,” he said. “And the cases at issue represent a small fraction of the thousands of taxable properties in Duluth. For every seven to eight people I talk to, only one actually ends up filing a petition.”
He said the reason for the large burst of claims is that, while everyone got their tax valuation notices in 2008, most didn’t look closely at their tax bills until they were issued about five to six weeks ago. And the deadline to file an appeal is April 30.
“I don’t think this is anything extraordinary, other than the times that have produced them,” Burns said.
Suzanne Miller, who owns a home at 1312 N. Ninth Ave. E., said the estimated market value of her home is too high, even after it was reassessed by the city in 2008. She filed a claim hoping to have the value reduced again.
“I’ve done a lot of research in my neighborhood, and "the homes are all assessed lower than mine,” she said.
Daniel Maryland, who owns commercial property at 332 E. Central Entrance, also believes his property is over-assessed.
“We are in a flood zone, so we can’t even utilize some of that land,” he said.
Maryland tried to handle his appeal himself but said he didn’t make any progress. Now he has an attorney and is hoping to negotiate a lower estimated market value on his property, something his attorney told him could take up to a year and a half.
Gellatly said he hopes to settle most of the claims out of court. If the property’s assessed value is lowered, the property owner gets a refund — which could mean a loss of revenue for the various taxing entities such as the city, county and school district. But because only a tiny fraction of property taxpayers are likely to get a refund, and because it could take months to years for the cases to be resolved, the harm should be minimal.
“Because of the volume and types they are, this will likely be spread out over years,” Duluth Chief Administrative Officer Michael Ashcraft said. “While there will be some impact, the bigger concern is the drop in local government aid.”

Any idiot knows that the penalty for not paying property tax is designed so that a property owner will pay. He just missed another payment on May 15 and has had to pay the penalty on that too. He is nothing but another DFL crook who got caught. He kinda reinds me of that Illinois Senator Burrhead who said under oath in January that he never talked to any of the Blagojevich team and now he is on tape talking with Rod's brother 2 months prior to his statement under oath and claims that this conversation clears him of any wrongdoing. Hey Burrhead, how about that oath this past January?
Cuneo is the face of what Duluth has become. Sad, pathetic, corrupt, DFL mafia controlled politicians stealing every last penny for themselves and for those who pay for them to get elected and when they do not pay their property taxes.
I hear tell that a well known DFL minion cleaned up the mess for Cuneo this past week. After all, it just wouldn't look good to have our own DFL Duluth Timmy Geithner in Duluth alongside our own DFL Duluth Barney Frank Jr., would it?

Our view: Cuneo, others in office held to higher standards

Cuneo paid up Friday just as news of his delinquency was breaking.
But the reality is that anyone who runs for public office is immediately open to a higher level of public scrutiny. They know that going in. And how they manage their private affairs offers insights into the ways constituents can expect them to manage public dollars. As much as Cuneo, or any other officeholder, may want the two to be “absolutely separate,” as Cuneo insisted they were yesterday, they are not. They cannot be.
The second-year city councilor already was running up his debt while running for office in 2007, something that should have raised red flags but instead slipped through cracks of the candidate vetting process.
He owed $2,428 on the home he and his young family occupy, and he owed $6,710 on a rental property. The tax bills went unpaid, and the penalties piled up, Cuneo has explained, because a business he was operating wasn’t doing as well as he would have liked and because he hadn’t yet landed the more stable position he now holds with the Zeppa Foundation.
“We’ve had to make decisions for the last three or three and a half years about which bills we could pay,” Cuneo said. To his credit, those decisions weren’t made politically (property tax debts are public record) but in the best interest of his family.
Still, Cuneo and his wife could have caught up on their debts by selling the rental property they obviously were struggling to afford. They considered it, Cuneo acknowledged, but then he landed the new job and their bottom line improved. They started saving to pay off their tax debt.
And pay it off they could have, if for no other reason than to stop the penalties from piling up. They certainly should have paid it off before reporters’ questions forced them to grab the checkbook.
“How long was he going to let it go? Until he got caught?” fellow City Councilor Jay Fosle asked last week, both fair questions. “That someone who has authority to raise taxes, and has raised taxes, and didn’t pay his own, I find astounding.”
So do more than a few of Duluth’s faithful taxpayers.

1. Four Good Questions for Local Governments
Despite the DFL legislators' “Misery Tour Part 2” last week, where they flew around the state to try and convince Minnesotans that they were right in attempting to raise taxes to balance the budget, Governor Pawlenty's stand against raising taxes has resonated not only in Minnesota but also across the country. Pawlenty has been staunch in his view that raising taxes is not a good idea, and he was able to follow through on that in a way that flat-out surprised the liberal tax-and-spenders.
Of course liberal tax-and-spenders dislike Governor Pawlenty’s opposition to tax increases because they can’t comprehend government living within its means. A group of mayors flew around the state crying that if Governor Pawlenty reduced city aid payments they would have to lay off cops and firefighters.
But Governor Pawlenty didn’t buckle. Instead he directed four simple questions to local government officials to be answered before they begin complaining.
1. Is there a rainy day fund that can be used?
2. Where is the money from property taxes going?
3. Has there been an employee pay freeze implemented?
4. How have they tried to downsize and streamline operations?
Number 2 and 3 really make me laugh. Where is all the money going? The answer from Mayor Ness on this one would be great to hear. Pay freeze, are you kidding me? In DFL Duluth where robbing the mom and pop is just standard operating procedure by AFSCME and DFD PAC.
STARFIRE: Adam, a pay freeze won't cut it. A pay decrease is needed either in pay cuts or layoffs. |

Duluth Commerical Property Tax Appeals Up
The number of Duluth commercial property owners petitioning their tax assessment has more than doubled this year compared to last, according to the city of Duluth's assessor's office.
68 commercial property owners have filed a petition with the Minnesota Tax Court against the city's assessor's office. That's compared to 29 last year.
The petitions are for payable taxes in 2009 and are based on an appraisal made in January 2008, according to John Gellatly, the city's assessor.
Gellatly believes the increased number of petitions is because property owners are comparing their current property value to the value of their property in 2008, which is likely lower due to the economic downturn.

If you think about it, over assessed market values could be a good tool to use to provide additional income for overblown salaries and benefits for public employees. Take that and the attitudes of some employees as outlined on the front page of the DNT today and this is a huge conflict of interest. These employess are representing the taxpaying citizen who pay their wages, yet mistreatment of the public has cost citizens even more.
Imagine people who have tried to work within the Civic Center who notice something isn't right or won't participate with the underground mob employed there. The more they try to bring awareness involving unfair or illegal situations, the more harassment and intimidation they will receive.
This is not the first time someone has been diagnosed with post traumatic stress syndrome after working there. How many citizens have received improper treatment at the hands of Duluths' public employees? Lots from what I've read and seen so now that's it's front page news it'd be nice to see our elected officials looking into this. Councilor Eckenberg is most likely aware of the many cases brought against St Louis County by citizens damaged by the actions of employees. Maybe he can start the dialogue to clean up this Big Mess in our City before we pass this tradition on to the next generation. |

6245 E Superior st sold in 2009 for $168,500 and is assessed at $146,800 but it also sold in 2002 for $130,000 and in 2005 for $159,900. You would think since it sold for $159,900 in 2005 it would be assessed at at least that value. You also don't know about "improvements" to the home. Surely one does not get all the info needed on the assessors site but it is a starting point for further investigation on certain properties when checking inconsistencies or if you are buying. |

Just to back up the story on the other Ho houses in Duluth. Here is what Mr. Duluth has heard over the years.
In 1984 or so, I knew of a place in the east end. I will not give the address for the fact this place still may be operating. The guy that told me about it was in trouble for DWI's all the time, but was on the road of recovery. He spent to much money there also he said..:) :)
Then there is Katie's in Superior. I think that place may be closed down, yet may have moved.
The best is last. In 1994, while going through a divorce, I was told about this lady, with a stable of 150 girls. I did doubt that number and was able to track this lady down and found out she had a book with pictures even, about 75 girls, most out of the Twin Cities. $275 for an hour dance and tips were extra. CAME with a body guard too? I also able to track down a girl who did work for this lady too and she was paid $125 from the $275.
I don't care what these people do and think this stuff is funny to be honest. I don't use Hookers, but know some under world thugs. Wait KNEW...Yeah. |

She is 18 turning 19 this week and regularly wears her high school hoodie or her denfeld high t shirt into the club. I could not bear it that she did what she does and that she had been talked into prostitution by the veteran dancers at the club so i had to break off the engagement. Her first john was a 35+ year old man named DELETED, they went to the DELETED in superior and got to business. this girl had always been damaged but now everything has a price tag. It isnt fair that she will never be able to live a normal life or that she will not be able to have a normal relationship. All this because the management at the club saw she was desperate and promised her an amazing life with no more worries. the police departments wont do anything to stop the flow of sex trafficers or prostitution in our backyards. They prey on your daughters on their freshly "legal" freedoms. As much as you try to instill values in your children the "pimps" have already found a way of talking around them. any thing you teach can be untaught by what they seem to offer. 1. Renters at 1831 E. 2nd Street were issued citations. This made the paper.
2. An interested party checked the address of the cited renters to see the property was owned by Tony Cuneo and accidentally came across years of delinquent taxes.
3. The press gets a hold of this and the “suffering young person” comes up with $9,200 within a couple of hours of being contacted by Kim Johnson of WDIO about Cuneo's property tax delinquency.
4. Looking in to the Tony Cuneo late tax matter, another person stumbles across the fact that there are at least 68 lawsuits filed against pending the city assessor in Duluth tax court. In fact one particular law firm in Duluth is very busy doing almost half of the filings.
Why have the tax lawsuit filings been covered up? Are there more public officials who are in arrears? Duluth businesses and people are getting fed up with the tax fraud going on here. I bet those running for office have been in and got caught up too, or they had better because people are watching.
This Cuneo event is the catalyst that has opened up Pandora’s box in local tax issues, just wait and see.

The taxes going on 4 years old should have been paid from the rents received. The Cuneos Schedule E would show how much they make off the rental. After all is said and done with depreciation and all they have to make at least $10,000 a year off of the rental property. If not, why is Mr. Cuneo handling our money?
Mr. Cuneo must make at least $75,000 at Zeppa with some kind of benefits.

Until Friday morning, a Duluth City Councilor owed thousands of dollars in late property taxes. But after inquiries from Eyewitness News, Councilor Tony Cuneo wrote a check Friday to St. Louis County for the full amount owed.
"There is extra motivation to pay when you know that the entire city of Duluth is going to be looking at your financial situation," Cuneo said.
Duluth City Councilor Tony Cuneo had owed $9,137.60 in property taxes and penalties, according to the St. Louis County Auditor's Office.
Cuneo was delinquent in taxes on two properties in Duluth. He owed $6,709.50 on a home he rents to tenants at the address of 1831 E. 2nd St. Those late taxes stem from 2006, 2007, 2008 and the first half of 2009.
On his current home at 827 Grand View Avenue, Cuneo owed $2,428.10 in late taxes dating back to 2008.
Cuneo said he couldn't make the payments because he was too bogged down with other financial responsibilities.
"I think it is probably a similar story for plenty of young people, a young family, college loans and the rental property and my house is an old home so it is expensive to keep up," he said.
Cuneo works full-time with the Zeppa Foundation. He says family finances have improved over the last year or two and says he intended to pay his taxes this summer.
"It's unfortunate it took this long," Cuneo said. "I could have started making some payments a couple months ago."
Fellow city councilors have mixed reaction.
"Councilor Cuneo has actually raised taxes since I've been on the council and if you're not paying your own, that is not right," said Councilor Jay Fosle.
Councilor Garry Krause said he is bothered that Cuneo ran for city council in 2007 while knowing he was delinquent in taxes.
"We all experience difficulties, but to run as a city councilor and know that you are not paying your taxes and haven't since, that is really alarming," Krause said.
Councilor Sharla Gardner did not want to appear on camera but said Cuneo's personal finances should not be a reflection of his work on the council. She also said attention paid to his taxes is a distraction from more important city issues.
I don't know what's more laughable, Cuneo's comments or Gardner's. I nominate Cuneo's:

He said news reports today that he owed about $9,000 in taxes and penalties prompted him to pay the taxes, though he and his wife had been saving their money and probably would have paid them soon in any case.
He owed property taxes going back to 2006 on a rental property and taxes since 2008 on the home he lives in.
He said his family was struggling financially like a lot of young families.
“We had to make some choices on which bills to pay,” he said. But now, he says they’re going in the right direction financially.

Okey-dokey, Chris Allen just won American Idol over Adam Lampert. Watch how long it takes for the liberal folks to say the Allen won due to the "anti-gay" vote. Just watch.
For the first time since this series has been running, I voted for Allen. Actually Gokey was my first choice. I have a feeling that Allen took a high majority of Gokey's votes and here's why.
Lambert is a really good singer but he was too theatrical and a lot of his songs he seemed to be screaming. Anyone can scream and my wife is a good example, but I think both Gokey and Allen were better signers. Not as good stage presence but, then again, you can put lipstick on a pig, and it's still a pig.
Both Lambert and Allen will probably end up with recording contracts, and I hope Gokey does too. But I never thought Lambert should've been in the final two due to the forced (or screamed) singing.
This is not a bias on my part based on personal life (you got that Claire) but watching the performers. Allen actually tried to downplay all this by saying that he hoped it wasn't a "Christian" vote.
Just my opinion. These performers will end up with contracts but I think the best performer won. |

I had the pleasure of taking two classes at Lake Superior College that Russ Stewart taught: Ethics 101 and Philosophy 101. He does have many liberal viewpoints and perhaps way left wing, with a conservative spending approach. I felt that he was an excellent teacher and council member.
I miss Russ on the council for the fact he did his homework. Now, he writes about this simple town and rips on some of the kingpins of the city in his writings for fun or for revenge. I do get a kick out of his approach and I see his angle maybe of enlightening the credulous masses.
I think Ralph Doty is making assumptions about Russ because that is what news people do.
