Had a good day at the DNT today. I pointed out 3 GLARING mistakes made by their crack writing staff. Of course, none of the 3 got posted, BUT the stories and pics were sure changed fast. THEN, 2 of my previous posts were magically deleted! But Jimmy Bellemy has assured me in the past that never happens. LOL! Yeah right!

So the DNT runs stories on a home invasion/assault and a burglary/assault. Naturally, all 4 of the suspects are BLACK, and 3 are not from Duluth. I tried to post that fact twice. Apparently the DNT found that offensive. Quite the ship and quite the crew you have there, little Bobby K.

I had to laugh at an earlier blog implying that there was a "smear" campaign against Beth Olson.

Let me get this straight? Re printing Beth Olson's own words is a "smear campaign"? A "smear campaign"?? You've got to be kidding?

This is reminiscent of a past Greg Gilbert campaign. I think Pat Spott was runing against him and the Chamber, before they turned totaly "progressive", had a political committee that was backing the responsible moderate Spott. The Chamber ran an add in the paper for Spott. The Gilbert campaign flipped out and claimed "dirty politics" and held a press conference claiming a "smear campaign"!

Do you know what the Chamber add mainly consisted of??

GILBERTS VOTING RECORD!

I'm not kidding. His own voting record was so bad that he considered it a "hostile add".

Unfortunately, instead of calling their own press conference to point out that Gilbert was complaining about his own voting record (which would have made Gilbert look like the total worm that he was) the Chamber guys put their tails between their legs and ran away! Again, I'm not kidding! They disbanded that Committee!

The Chamber hasn't had any "balls" since!

Interesting times on our UMD Campus the past few weeks:

The two top GLBT, "diversity", OBSSESED women at UMD are very publicly at odds with each other over the Raymond thing. (The Diversity "Board" can't believe the boss is sticking up for a man! Ick!)


The not so funny joke going around campus is - (So, as long as the women at UMD that you harass are merely heterosexual, you get to keep your job??) We're all wondering what would have happened if the women harassed, were "gay"? Seeing it's UMD and part of the University of Minnesota System, uh ya, I think we all know how that would have gone down!

Funny thing, the Administration/faculty/staff on campus are overwhelmingly ultra left liberals. (the few that are not liberal have learned to keep their mouth shut) They, the libs, make the mistake of assuming that ALL the student body must think like they do on everything. After all, they are "college students" you know. They'd actually be shocked out of over 11,000 students, just how many of them are moderates! Some are even, gasp, conservative!

More likely that Martin kept him employed because he was at one time her personal trainer. Nepotism, yes. Politically motivated... I think you're looking for a reason to slam liberals that isn't there.

UMD fans are very-very loyal. Considering we nearly always finish under 500 every year, we still have a very big fan base. UMD's non student fans are also very-very quiet at the games. If it wasn't for the student section, we wouldn't even have a home ice advatage in our own arena!

All the student section has to do is use a little common sense, acknowledge that there a few certain words they can not yell, and everything will be just fine. No "F" word, nothing too sexual and everything will be fine.

This time the GLBT people got offended, and it got on the front page.

Police remind citizens to continue to lock the doors and windows of their homes, use exterior lighting to deter crime, and report suspicious people or circumstances by calling 911. Anyone with information on these burglaries is asked to call the Property Crimes Unit at 218-730-5160.

I am shocked and rapidly loosing respect for any full-time fire fighter who would put down citizens who are just pitching in. I can guarantee you that if there were not volunteers fire departments people who live outside the city limits would not be able to afford house insurance.

A little drinking at a volunteer fire hall is no more disappointing than a drunken woman breaking her leg at a city owned fire hall or a fireman who racks up a few DUIs.

If you're so in the know, then where the hell do you work where you wou would protect the volunteers? The vollies I know have 2 meetngs a month. One is a training meeting and the other is a hall maintenance meeting. Real professional!! I was with a volunteer rescue squad many years ago and they were a bunch of wannabe's who gassed up the million dollars of equipment they had once a month. We never beat the Duluth firepeople to a run. Believe me, I tried. I lived in Duluth and had to go to Pike Lake to get into the rescue rig to respond back to Duluth. Crazy!
I don't care who you are and I know the truth behind these people. I've been there!

I just got word that Channel 6 has pulled the story about Katies killer. My family and I want to thank everyone for all of there hard work in contacting Ch 6 on Katie's behalf. That's exactly what you all did, you were KATIE'S VOICE! That killer took her body and her voice from all of us but didn't take her soul. That lives on through all of us I see that now. The crux of this case, according to the Court, revolves around the language used in the following paragraph within the CBAs (Collective Bargaining Agreements) between the City and the Collective Bargaining Units (CBUs). As noted in the Findings Of Facts (pg. 3, #11):

Version A: Any employee who retires from employment with the City...shall receive hospital-medical insurance coverage to the same extent as active employees, subject to the following conditions and exceptions...

Admittedly, I cannot find fault with the Court’s interpretation of Item A. I’m convinced that most people, upon reading that single paragraph by itself, would agree that the intended meaning is not ambiguous. However, there is much more to this case than just Version A, to wit the following:

Item B: Retirees and disabled employees who are receiving a pension may retain health insurance coverage as provided under the terms of the current labor agreement under which he/she resigned or retired (see current labor agreement for your bargaining unit).

This paragraph, also noted in the Findings Of Facts (pg. 5, #25), is from a document provided by the City to people who contemplated retirement or have retired from the City. Its existence casts a shadow of doubt upon the interpretation of Version A, and if genuine, it is clear evidence that some ambiguity must exist concerning the interpretation and intent therein. It is the viewpoint of the Plaintiffs’ that the meaning of Item B closely mirrors their understanding of how the retiree health benefits have been and should be administered, as described by the following:

Version B: Retirees (Plaintiffs’) health benefits are fixed and governed by the plan in place on the date of their retirement.

The Court addresses the doubt raised by Item B in two ways. First, by attempting to diffuse this evidence by stating that the meaning of Item B is concurrent with Version A, and that it simply refers the reader back there for further details (pg. 5, #26). But, that makes no sense. That certainly cannot explain why the word ‘current’ is used twice in the document, nor can it account for the phrasing: “...under which he/she resigned or retired...” If the contract was meant to be interpreted as the Court suggests, then the use of these words and terms are totally unnecessary. There would be no reason to make reference to ‘current’ labor agreements, if everyone were to be treated the same as active employees. The use of the word ‘current’ implies that change could occur, and if that change does occur, the information being sought will be located within a different document.

Likewise, if retirees were to be treated the same as the active employees, there would be no point to make mention of the ‘labor agreement under which he/she resigned or retired’, since that specific agreement would be null and void, replaced with a new edition, and the retiree would need to reference that new contract. The connotation being that since agreements change, one must consult the agreement under which he/she resigned or retired. In fact, this entire document would be pointless and unnecessary, if it were to mean the same as what is stated in Version A.

So, it is clear that Item B contradicts the language of Version A, and standing alone, it upholds the Plaintiff’s contentions. I’m confident that most people would agree that the language of Item B indicates the same basic concept of Version B Furthermore, I believe that the Court also understands this, and could not truly doubt the validity of this document, as I’ll explain later.

Secondly, the Court slams the door on any further inquiry from this quarter, by declaring Version A to be a contract that is neither incomplete nor ambiguous. This is accomplished by citing numerous precedents of case law, after which the Court is then empowered to disregard from consideration any evidence concerning the intent of the parties involved with the contract (pages 9-15). In other words, no matter what the parties to the contract may have intended to agree upon, the law proclaims, “it is what it is.”

Naturally, to base the verdict in a case like this solely on the letter-of-the-law, may seem somewhat unfair. Especially when one considers all of the extraneous information, as well as the emotions involved. To the Court’s credit, this was recognized, and the Court proceeded to analyze the matter under the Promissory Estoppel theory as well (pages 15-16). But, while this was certainly the right thing to do, it presents the Court with a very slippery slope to traverse.

For those unfamiliar with Promissory Estoppel, the following three items were taken from the internet and will provide a basic understanding of this legal theory.

“A promise made to another party to a contract that the contract will be waived or not enforced, in whole or in part, and which, once acted upon by the promisee, prevents the promisor from taking subsequent proceedings to enforce the contract.”
"The application and the attractiveness of the notion of estoppel is quite easy to appreciate. One party enjoys a legal right under a contract. That party says that it is not going to enforce that right on a particular occasion. The other party relies on that representation and acts accordingly. Then the first party changes its mind and decides that it does want to enforce its strict legal rights; but only after its counterpart has irretrievably committed itself. The equitable doctrine of estoppel is designed to prevent such an unfair tactic...."

"To use a common metaphor, you are not allowed to let someone go out on a limb so that you can saw him off."

The Court, once again relying on legal precedents, declares that for it to support a Promissory Estoppel claim, the promisee must show (1) a clear and definite promise, (2) intended to induce reliance, (3) on which the promisee relied to his or her detriment, and (4) that must be enforced to prevent injustice (pg.15). The Court further cites that judicial determinations of injustice involve a number of considerations, “including the reasonableness of a promisee’s reliance” (pg. 15).

Despite this seemingly complex task, the Court completed the analysis of this case vis-a-vis Promissory Estoppel, and was able to present a complete explanation within three paragraphs. The Court decided to take issue with only the fourth prong of the requirements. Why? Quite simply, that was the only avenue open to manipulation. Plus, any open examination of the first three requirements would actually jeopardize the Court’s ability to take issue with the fourth prong.

Still, let’s suppose that the Court had taken issue with the first three requirements. To contest the first requirement, the Court would need to explain why there exists a preponderance of evidence that there existed complete agreement between the City and CBUs regarding the health insurance benefits for retirees from 1983 until the current City administration. To wit, all employees who have retired since 1983, have in fact, had their health benefits fixed and governed by the plan in place on the date of their retirements. This is truly an instance where actions speak louder than words, because for that to occur, it is obvious that all parties had to be in complete agreement and “on the same page” as to the accepted meaning and actions regarding retiree health insurance.

The Court certainly recognized that for a scenario like that to continue to exist for all those years, enduring multiple changes of the city’s administration and numerous CBAs, that some form of an agreement between the parties had to exist. Especially when each and every contract was argued and reviewed extensively by both parties. Any suggestion to the contrary would require a monumental stretch of the imagination, and call into question the integrity and intelligence of everyone involved.

It follows then, that if such an agreement was not in the form of a written contract, then it most certainly had to be either an oral contract, an unwritten policy, or at the very least, a gentlemen’s agreement. But, it had to exist. To believe otherwise is absurd. And that is precisely why I stated earlier that the Court could not have doubted the validity of Item B, and the implications therein. If it truly thought otherwise, the Court would have undertaken a discussion on this point. Instead, the Court chose to be obtuse about the meaning of Item B, the only physical piece of evidence that implies an official agreement between the parties. One could speculate here about what other documentation supporting the Plaintiffs’ position might be readily available, were it not for the protection afforded by the attorney-client privilege on the part of the City.

The Court likewise knew better than to take issue with requirements (2), and (3), of the Promissory Estoppel theory. Clearly, a span of 25 years, wherein the City allowed the retirees to maintain their health benefits as fixed and governed by the plan in place on the date of their retirement, is sufficient enough in nature to convince anyone that such action would intend to induce reliance. In fact, that definition of the retiree health benefit was considered common knowledge amongst all city workers. I can personally attest that from the day I was hired in 1983, and throughout my 22.5 years, and including my exit interview, I heard not a single contrary explanation of the health insurance benefit for retirees. Furthermore, the city’s current administration, the defendant in this case, would be very hard pressed to find anyone from the past who could testify differently. The court heard testimony to that effect from Paula Savela.

Naturally, the reliance based upon the promises and past actions of how the retirement health benefits were being administered, had to have an effect on every retiree’s plans, starting with the life-changing decision of when to actually retire, and encompassing every financial decision they have had to make since that day. For the Court to argue that reliance on these promises would not be to the retiree’s detriment, would be ludicrous.

Which brings us back to the one issue of Promissory Estoppel upon which the Court has boldly hung its hat. Taking issue with the fourth prong, the Court contends that it would be unnecessary to enforce Promissory Estoppel in this case, because there is no injustice. That’s because, according to precedent, a Judge must consider whether or not the Plaintiff’s reliance on the aforementioned promises are reasonable. If they are not, there is no injustice. The Court could find no facts to support the claim that the Plaintiff’s reliance on the City’s promises were reasonable. Thus, there is no basis for Promissory Estoppel and that claim is denied. Judgement for the City. End of story.

Wait a minute! Time out! What just happened there? If this were a poker game, this is the moment I’d be demanding to inspect that deck of cards the Court is using. And, for good reason. The Court just changed the rules of this game, declared a wild card, and slipped another ace into its own hand! And that was all accomplished in just the last three paragraphs of the Judgement (pg. 15-16).

When the Court chose the fourth prong to take issue with, it also referenced a precedent to help it define the subjective term of injustice. This helpful term was, ‘reasonableness’, which also carries a subjective definition. In the contract law portion of this memorandum, the Court went to great lengths explaining how all the precedents it cited applied to its decision. Here, however, the Court offers no such illuminating discussion, thereby making it impossible to determine if the context from which the quotes came, has any relationship whatsoever, to the matter at hand. With no concrete definition of ‘reasonableness’, the Court could create its own definition and the wild card it needed.

The Court then determined to hold the Plaintiffs’ arguments up against the CBAs, to demonstrate just how unreasonable those claims and expectations were. But the Court had a gigantic problem. Under the Promissory Estoppel theory, the Court had already accepted that the Plaintiffs’ were under the distinct impression that their benefits were contractually fixed and governed by the plan in place on the date of their retirement as per Version B. If the Court were to make a comparison of the Plaintiffs’ position versus Version B, the Plaintiffs’ would not seem unreasonable at all. The Plaintiffs’ would be seen as getting exactly what they had expected and been promised. And no reasonably altered definition of ‘reasonableness’ could change that. Something more was needed.

The Court realized that it had the perfect tool for this in the form of Version A. It could use the very contract (Version A), that it had made a ruling on via contract law, within this very same memorandum. But, would that be considered proper? Should the Court take the matter-in-question, make a ruling on it, and then in the process of looking at that same matter-in-question from a second, but totally different legal viewpoint, use its own previous ruling on the matter-in-question and insert that ruling into the argument of the second matter-in-question, knowing that in doing so, it will undoubtedly influence the second decision on that same matter-in-question? That’s a good question, and it begs others. Would that be logical? Would that be good law? Would that be fair? Would that be applicable to determining if the Promissory Estoppel theory applied here?

No matter. The Court went ahead and did exactly that, thereby changing the rules of the game and slipping an extra ace into its hand. And, it was against this new ace, Version A, that the Court chose to compare the “ ‘reasonableness’ of the reliance’ “ of the Plaintiffs’ position. The Court also chose that moment to play its wild card. The Plaintiffs’ position now appeared untenable. With the Court’s attachment of a monetary definition to ‘reasonableness’ and linking that to Version A, the Court achieved the desired result. It now would appear to anyone reading the Court’s decision that the Plaintiffs’ position in this matter, is nothing more than greed coupled with a sense of entitlement.

Was the Court aware of an undertone of bias within that argument? Apparently not. It’s equally apparent that the Court failed to recognize the contradiction and double standard it implied. The Court purports that no facts could be found in the record to support the reasonableness of the Plaintiffs’ reliance. Yet the Court arrived at its determination of the Plaintiffs’ unreasonableness by comparing their position against Version A and rising healthcare costs, and displayed further knowledge of these rising costs in the final paragraph. It was, after all, the Court’s decision that ‘reasonableness’ could be determined using some sort of monetary standard, thus making that knowledge necessary.

So, how does it follow that the Court has sufficient information about high healthcare costs and its effect upon the City, but knows nothing of how that same information might relate to the Plaintiffs’ own finances? If the Court comprehends healthcare cost information from the City’s position, it should be able to make the correlation to an individual’s viewpoint. Precisely what facts did the Court lack? Were the Plaintiffs’ required to explain their personal finances to the Court? Would the Court have been impressed with a simple linear chart showing the percent effect of healthcare costs on individuals? Or would the Court have preferred to peruse a glossy, professional presentation, complete with colored graphs, pie charts, and the necessary documentation required to explain all those red numbers and their implications on future budgets? It would have been nice to know beforehand.

Ultimately, what the Court undertook and presented as its analysis of the Promissory Estoppel theory leaves much to be desired. The brevity, reasoning and subsequent conclusions the Court derived from its foray into this theory, falls far short of producing a convincing argument, let alone a reasonable attempt at justice.

Don't forget something like half of all Duluth fire fighters don't live inside Duluth. A well trained volunteer rescue squad made up of people who lived inside the City of Duluth could be added insurance for the public safety of Duluth Citizens. Public employees while wonderful are very expensive and the taxes are killing many of us.

I would love a fire fighter as a neighbor but like I said many of them do not live in Duluth so a volunteer rescue squad neighbor would make a good second choice.

How about a task force to look the idea over?

Shocking ignorance of the collective bargaining process. That’s about the only way to describe the article by your Virgil Swing.

Let’s give a bit of history of labor/management history in the U.S. and Minnesota in particular.

In 1935, the U.S. Congress, at the urging of president Franklin D. Roosevelt and many others involved with the labor movement in the country who were fed up with the arbitrary treatment of those who delivered their skills and expertise to the growth of this nation, passed the Wagner Labor Relations act. That law guaranteed the right to organize unions and further guaranteed the right to good faith negotiations for wages and terms and conditions of employment. It, the Labor Law, gave workers a seat at the table. It did not disrupt owners or managers their right to manage.

Public employees were left behind with no assurances of fair treatment by their employers.

In 1971 and with corrections in 1973, the Minnesota Legislature approved the Public Employment Labor Relations Act, PELRA, which assured public employees the right to good faith collective bargaining, mediation, arbitration, and with the exception of police, fire and certain hospital workers, the right to strike when negotiations reach an impasse.

With few exceptions around the state, PELRA was the correct remedy for the injustices which were foisted on public employees and everybody was satisfied.

In 1982, the public employees of the City of Duluth listened to a proposal by the then Administrative Assistant to the mayor, that they, the employees, reduce their demands for an equitable pay adjustment, forgo the accumulation of sick leave days and back off on several minor benefit requests. In lieu of this the City would assure retirees a guaranteed medical-health plan for their lifetime. Needless to say, the unions negotiators were hesitant, but agreed to bring the proposal to their respective memberships. Heavy debate followed, but the logic that the proposal would relieve the homeowners tax burden and at the same time allow for a zero tax increase in the budget. The City negotiators assured us that this, the health plan, would be an annual budget item. All unions accepted the proposal. With the departure of Mayor Fedo, the new administration blew the budgeted money on frills such as a fish tank, aquarium and the so-called technology village, no budget since included retiree health care.

Donny Ness became mayor and felt that retirees would be an easy, defenseless target and made his pronouncement that he was going to eliminate that which was guaranteed by Agreement, I.E., contract. He claimed an unfunded liability.

We, the ad hoc committee of retirees formed to try to protect retiree rights were not successful in Round one, not because we were wrong, but perhaps we had a judge who was not familiar with collective bargaining rights. PELRA prohibits unions from negotiating for retirees and the contracts of each of the City unions states lists those who are covered by their negotiations and eventual contracts. Retirees are NOT included in that list. The judge ruled that whatever the current unions negotiated covers retirees.

Thus, it is the strong belief of all City of Duluth retirees that the judge erred in his decision, and there are more than several court decisions in Minnesota which support our position.

I will conclude by referring to the Webster Dictionary definition of CONTRACT:

"An agreement between two or more people to do something, especially one formally set forth in writing and enforceable by law.”

We will be appealing to the Minnesota Court of Appeals!

There's about ONE BILLION DOLLARS the taxpayers are obligated for between the city and schools.

There is only one party who had political control of Duluth and the is the DFL. Stop blaming others DFL. Bonding is governments borrowing.

Pawlenty, Bush, Republicans had nothing to do with the DFL’s lust for borrowing with no regard for tomorrow’s future taxpayers.

DFL Duluth hasn’t seen sound fiscal practices in the last 40 years. Would you want to take on the tax burden left by decades reckless DFL spending?

The cost of government is keeping employers out along with the union “us vs. them” mentality. Bankruptcy maybe the only way out as the poverty rate is twice the state average and it’s not going to get any better in DFL Duluth.

Just wait until the tax delinquencies and taxpayers leaving DFL Duluth double. There will not be enough taxpaying people no matter how much you tax them.

Good luck DFL Duluth AFSCME and DFD owned politicians but you need more than luck. You need to cut the umbilical cord to your union and DFL special interests or take the city down a burning path to bankruptcy.

A review of the Duluth schools’ audits for fiscal years 2007 and 2008 reveals concerns regarding the future financial condition of the district. The items listed are declining enrollment, school choice, state budget, medical insurance and retiree benefits.

I found that during the past four years, declining enrollments and school choices have caused a net loss of more than 1,300 students to the district, costing a loss of millions of dollars in state aid going to other districts and schools.

Money from the state of Minnesota accounts for more than 71 percent of the district’s revenues, and declining revenues impact spending on education.

The district’s medical-insurance costs have nearly doubled in the last six years to almost $16 million annually, the audits indicated. Plus, the district’s self-insuring dental payments for fiscal year 2008 were $757,000.

Unfunded liability for retiree health care and severance, as of fiscal year 2008, was $41.9 million.

The district’s general fund has had a net deficit the past four years of

$12.2 million after the sale of capital assets of $1.2 million. These deficits appeared to have been covered by the district’s reserve funds, which now seem to be virtually gone.

The district balanced its 2010 budget deficit of $4.5 million by laying off

55 teachers. According to district officials, a teacher’s average salary and benefits total more than $80,000 a year. This action reduced instructional specialist time for elementary students in art, music and more and reduced course options for middle school students along with increased class sizes throughout the district.

Middle school students are being taught in

12 portable classrooms at Morgan Park and Woodland with some busing from Lakeside and Piedmont Heights to Morgan Park. Everyone can see the huge impact all students are enduring for the red plan.

Taxpayers are obligated for almost half a billion dollars with the red plan and unfunded liability for retirees. The local levy for 2006, according to the audits, was $13.8 million, with 79 percent going for education and 21 percent for debt service. The local levy for 2009 was $23.8 million, with 38 percent going for education and 62 percent for debt service.

The cost for the red plan, before any assumptions, is $431 million, and Plan B is $302 million before any assumptions, with voter approval — a difference of $129 million.

Common sense tells everyone these two plans are not the same in terms of costs for taxpayers, as the district and News Tribune continue to tell us. The district and its red plan consultant, Johnson Controls, seem to assume the district will have operational savings of $122 million over the next 19 years. I, for one, do not believe this is a realistic assumption. I think there will be a need for increased local levies to service debt the next 19 years.

Everyone is aware of Johnson Controls’ assumptions for the city of Duluth’s steam plant. That issue is currently in our courts with the city arguing Johnson Controls’ assumptions were overstated by millions (“Johnson Controls, Duluth at odds over cost savings,” July 24.

Remember the Duluth Omnimax theater and Great Lakes Aquarium and the great assumptions about them? Today they are on life support.

My question for everyone: Why hasn’t any of this data been given to the citizens of the district? The Duluth Chamber did not provide any cost figures in its support of the red plan. Why? Because it was too expensive and time-consuming? All citizens have seen or heard is how great the red plan is without any consideration for the costs and ability of citizens to afford the debt service and the education of our students. Unless citizens vote for $5 million or $10 million referendums, I don’t see how we’ll be able to afford the education of our students.

The red plan can be altered with the election Tuesday of Maureen Booth, Art Johnston, Tom Kasper and Marcia Stromgren.

Did you all see the two letters to the editor in today's DNT? Daniel J Golden's letter was basically a mean-spirited rant against Progressive Action and against the DNT for not endorsing his buddy Rob Wagner, who is running against Patrick Boyle for 2d District City Council. There were also insults directed at Boyle himself. But the letter lacked any argument for WHY I should vote for Wagner. Dude, don't just bitch and complain about Boyle and his supporters, give me some good reasons for voting for Wagner! And, "he's a minority" doesn't cut it with anyone.

The other letter, in contrast, by me, Claire Kirch, was a well-written, positive, and articulate argument explaining why people should vote for Beth Olson. There was no anger, no hatred, just solid recounting of what Olson has done in the past, her personal qualities, and her qualifications for city council. I know everyone here's foaming at the mouth because I’m a "supposedly elite" college back East, but if that kind excellent writing and well-thought-out reasoning are what going to a "supposedly elite college" gives you, then we should all be so lucky as to have someone like that advocating for us, rather than Daniel J Golden, whose poorly written and inarticulate arguments would not persuade a half-wit to vote for Wagner over Boyle.

Having smart and upbeat people like me in her corner is why Beth Olson is going to prevail Tuesday. Having angry jerks like Daniel J Golden in their corner is why Rob Wagner is going to lose and lose big Tuesday.

The guy had no clue, he said they are both good candidates endorsed by the local unions. I asked what unions and he said the fire departmenmt and AFSCME. So I told him I don't belong to any union and won't just vote because of an endorsement. Exact words from this worker. "Well, just don't vote for Stauber". I then told him to get the hell off my property and take his flyer of my door in which he did. As he walked away I noticed the back of his shirt say in big white letters Duluth Fire Can you say sheeple?

When I asked her if Beth is still working at DAIP she said it didn't matter to her and she was only concerned that Beth get elected. I asked her if Beth got fired and her response was, IT DOESN'T REALLY FUCKING MATTER, WE NEED BETH ON OUR COUNCIL. I walked away from my FORMER friend in disgust. It matters to me. As a conservative member of the GLBT (and there are some) I will cast my vote on Tuesday but not for Beth. I expected honesty to my answer and I got nothing. This whole issue is concerning to me.

Speaking of volunteer fire departments...

What do the DFL/DFDers think of Extreme Home Makeover? All those wanna-be carpenters, designers, architects, etc.? How qualified could they be, really?

Not to mention the volunteers who serve in many different capacities every day.

I'm not saying that the fire department is shoddy or not worthy of being around. I'm saying, firefighters, don't knock volunteer firefighters- they have saved lives and property, too- and what the hell are you people griping about, anyway? The City of Duluth doesn't have volunteer firefighters, and I doubt that it ever will. Maybe the taxpayers won't be able to afford the wages/benefits that your union has managed to secure for you...some of you may be let go, or perhaps you will settle collectively for a wage that our local economy can realistically sustain, rather than having some of your brothers and sisters lose their jobs entirely.

All of us are finding ourselves making sacrifices as we settle for compensation that may not be as much as we want, but at least we still have a job.

Trouble is, our wages don't rise in tandem with property tax increases, unlike most government employees. In other words, we don't get an eventual raise after our taxes have been increased.

Another thing...it irks me when people gripe that the firefighters have alot of 'down time.' What should they do, hire some idiot to go around setting fires to keep them busy? My own job can have some down time, too, but of course on a much lesser scale. When you're on so-called 'down time,' you need to keep yourself coiled like a spring.

Finally, I won't vote DFL. Not because a couple of candidates are gay, or even because they're pro-union, even. It's because most of them are sorely lacking in fiscal common sense, and they seem to like to use their political authority and clout to push their personal social/financial agendas into the taxpayers' wallets.

That's pretty franken sociopathic, if you ask me.

I saw them at the Hermantown safety expo also. You know the safety expo where cops and volunteers bring the rigs from as far away as Hibbing to show off while their community is left unprotected... Anyway, they had some BS rope rescue drill they were doing where they put ropes over a roof peak and ran side to side on the way down to fake rescue someone.
Lets see, rope on a asphalt roof peak rubbing back and fourth? SMART!!!! So, NO, leave the city work to the REAL professionals!

• September produced another 531,000 unemployment claims.

• 43 states have reported job losses for the month of September.

• There are 1.7 million people that have had their unemployment benefits run out since Jan/2009.

• The unemployment rate is 9.8% (yeah right), they don't include the 6.2 million that have lost benefits, F/T employees cut to 30 hour work weeks, seasonal employment, Ag, and 600,000 who have simply quit looking for work.

• Unemployed amongst teenagers is 52.2%.

• Government mandated Minimum Wage increases caused businesses to cut another 300,000 in jobs for September for teen employment.

• There are now 37 million people on food stamps.

• There are 1.6 million homes in foreclosure, and the 4th quarter 2009, and first quarter 2010 is expected to bring another 400,000/600,000.

• There have been 1.1 million Bankruptcy filings this year.

• Government sources (Dummycrats), want another Stimulus Package. Bet you tax payers can't wait, eh? The 1st one worked so well, but don't worry, you're gonna pay for it!

• Government sources stated job losses are the worst since 1948.

• Government sources stated American's are working the shortest work weeks since 1951.

• Government Treasury sources reveals $106 "Trillion" dollars in unfunded liabilities. Can you tax payers handle that $343,747 dollars that your Government has burdened you with? That figure is for every American, from new born to 100!

• The Government deficit has Quadrupled since Jan/2009 to $1.8 Trillion Dollars. Q. How are they going to blame that on Bush?

• 63% of all baby boomers now can not retire, and will need to work till death ( good news for the government ).

• Media headlines..............No Jobs, No Credit, No Sales!

• Oil is $82.00 a barrel and climbing thanks to our "Fiat" dollar currency.

• FDIC reports record bank closings.

• FDIC needs another $500 billion for regulatory needs.

• GM needs another $35 billion (get it from the unions, not the tax payers!). Let them fail!

• Colleges have hiked tuition another 6% this year (apparently they haven't heard about the Recession).


O.K., have you have enough good news today? I've got news for ya folks, it's going to get worse. Just keeping you informed just in case you haven't came out of your shell yet. You wanted Change, you got, and it's going to cost you more for that change. When Obama gets done with us, we'll all be lucky to have change. Peace, and don't give up your guns!

Hot off PDD. It's official. "C" has expressed her hate towards Rod Raymond. Dennis Fink is also a target of local "progressives".

"C". Please clarify the phrase "disrespects women". What the hell do you mean by that? If Rod was a "chubby chaser", I doubt you would be so critical. I know it's not fair. Afterall he most likely only "disrespects" cute women.

"I’ve never met Rod Raymond, though we have mutual friends. But I do know Deborah Petersen-Perlman very well, she’s the one who wrote the report advising UMD to cut him loose. She’s a pretty sensible person, and I can’t see her exaggerating the problem of his sexually harassing women if she’s hearing about it from young women. And yeah, someday, some woman is going to sue UMD b/c he’s got a pattern of inappropriate behavior and they’re looking the other way. He sounds like he basically disrespects women, and I really hope he gets some counseling before he and UMD get slapped with a lawsuit. This kind of behavior is just inappropriate and should not be tolerated. And, yeah, Maria is right, Dennis Fink is just as bad, and I hope he gets voted out next election. I’d rather not have someone who treats women so disrespectfully representing me."
